BREAKING: Judge Officially Dismisses Tirzepatide Lawsuit Against Mochi Health

UPDATED: The article has been updated to state that the case has not been dismissed against Mochi, rather a motion for “Statement of Recent Decision” has been granted to the defense.

After a long week of GLP-1 news, confirmation came early Friday that the case Eli Lilly filed against Mochi Health is one step closer to dismissal. This comes after last week’s motion to dismiss hearing attended by friend of OTP, Sabin Hemmi. Judge Jacqueline Scott Corley granted a motion from the defendants allowing them to file a “Statement of Recent Decision.” This procedural move gave Mochi, Aequita, and their co-defendants the ability to introduce a new legal or regulatory development into the record, likely to strengthen their position. While it doesn’t necessarily decide the case, it signals that the defense is actively pushing back.
